Terms of Service
Last updated November 7, 2026
These terms are an agreement between you and Matt Gutierrez, who operates CASTCADE ("we", "us"). By creating an account or using CASTCADE, the app or its websites (getcastcade.com and castcade.me), you agree to them. If you don't agree, please don't use CASTCADE.
1. Who can use CASTCADE
You must be at least 13 years old. If you're under 18, you need a parent or guardian's permission, and they agree to these terms for you. You can't use CASTCADE if you've been banned from it before, or if the law doesn't allow you to.
2. Your account
Use accurate information and keep access to your email secure. You're responsible for what happens on your account. Don't impersonate anyone, and don't create accounts by automated means.
3. How Shoutouts work
- The person who starts a Shoutout chooses who it's for, its title, who can join, and when it drops. Before the drop they can change those or cancel it.
- Share links are open invitations: anyone who has the link can join and add a clip. Share them with people you trust. The starter can turn a link off at any time.
- After the drop, the Shoutout belongs to the person it was made for. They can hide clips or delete the whole Shoutout. People who added clips can remove their own clips.
- Clips can still be added for a limited time after the drop.
4. Your content
You own the clips, photos, text and other content you post. To run CASTCADE, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example, to make thumbnails or play effects) and display your content to the people it's shared with, as described in our Privacy Policy. This license ends when your content is deleted, except for copies kept for a limited time in backups, or where the law requires us to keep it.
Only post content you have the right to post. When a clip shows other people, make sure they're okay with being in it.
5. Community rules
CASTCADE is for lifting people up. Don't post or use CASTCADE for:
- bullying, harassment, threats, or content meant to embarrass or hurt someone;
- hate based on race, ethnicity, religion, disability, gender, sexual orientation or any other protected characteristic;
- nudity or sexual content, and never anything that sexualizes minors;
- violence, self-harm encouragement, or illegal activity;
- spam, scams, or impersonation;
- someone else's private information, or content you don't have rights to (including other people's music or videos);
- interfering with CASTCADE: hacking, scraping, or getting around blocks or limits.
You can report clips and people, and block anyone, in the app. We may remove content, limit features, or suspend or end accounts that break these rules, and we may report illegal content to the authorities.
6. Music and app content
The music tracks, stickers, effects and designs in CASTCADE are licensed to us or made by us. You can use them in your Shoutouts in CASTCADE, but not separately.
7. Ending your use
You can stop using CASTCADE and delete your account at any time in Settings. We may suspend or end your access if you break these terms or to protect others, and we may change or stop CASTCADE or any feature. If we end the service entirely, we'll try to give you notice.
8. Beta
CASTCADE is in early testing. Features may change, break or disappear, and data may occasionally be lost. Please keep your own copies of anything important.
9. Disclaimers
CASTCADE is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, non-infringement, or that it will be uninterrupted or error-free. We're not responsible for content people post, though we act on reports.
10. Limitation of liability
To the fullest extent the law allows, we won't be liable for indirect, incidental, special, consequential or punitive damages, or lost data, profits or goodwill, arising from your use of CASTCADE. Our total liability for any claim is limited to $100. Some places don't allow these limits, so they may not apply to you.
11. Indemnity
If someone brings a claim against us because of content you posted or your breaking these terms, you agree to cover our reasonable costs, to the extent the law allows.
12. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes will be handled in the state or federal courts located in California, unless the law where you live requires otherwise.
13. Changes
We may update these terms. We'll change the date at the top, and tell you in the app before significant changes take effect. Continuing to use CASTCADE after that means you accept the new terms.
14. Apple
If you got CASTCADE from Apple's App Store, these terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance, isn't responsible for claims about the app, and is a third-party beneficiary of these terms, entitled to enforce them against you.
